All reasonable steps are taken to ensure that the material published on these Sites meets all legal requirements and does not offend. BACKGROUND:
This agreement applies as between you, the User of this Web Site or Client and Events 4 Healthcare Ltd (from here on known as “the Company), the owner of this Web Site (pharmajobs.co.uk). Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop using the Web Site immediately.
1.Definitions and Interpretation
In this Agreement the terms below shall have the following meanings:
“Account” means collectively the personal/company information and credentials used by Clients and Users of any System on the Web Site;
“Advertisement” any advertisement including job listings, premium banners, home page banners, featured recruiter, company profile, job alert sponsorship, digital mailers, social media posting;
“Applicant” a candidate that applies for a vacancy advertised on the site;
“Candidate” a person who uses the Site for the purpose of finding employment or seeking information;
“Company Profile” a page that allows Clients to give details about their company including but not limited to company overview, news, awards, contact details;
“Conditions” these Terms and Conditions;
“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;
“Contract” the contract for the supply of any Services by E4H to the Client comprising a signed agreement;
“Client” any person using and purchasing Services, where a Person includes bit is not limited to, Direct Employers, Recruitment Agencies, Recruitment Processing Outsourcing companies acting on behalf of one of their own End Clients;
“CV” the curriculum vitae, resume or details of a candidate’s education, training, skills and employment experience which is provided to E4H by a Candidate for distribution to Clients with a view to securing employment;
“CV Bank” service which allows Clients to search for and view CVs online;
“Direct Employer” a Client who in relation to the Services is receiving them for the purpose of their own recruitment needs and not on behalf of any 3rd party End Client;
“End Client” the person whom the Client’s services are provided;
“Featured Recruiter” a button on each page of the Site that allows companies to include a logo and text;
“E4H” means Events 4 Healthcare Ltd, 3 Waterloo Farm Courtyard, Stotfold Road, Arlesey, Bedfordshire, SG15 6XP
“Job alerts” emails sent to Candidates detailing jobs that are related to their Search Criteria;
“Job Listing” a vacancy that is added to the site and is included in the job search results where it is applicable to the search criteria;
“Logo” Client logo/image for use on job listings and company profiles;
“Premium Banner” a banner that can appear on any page of the Site above the main content;
“Recruiter” any person working on behalf of the Direct Employer or Recruitment Agency Client and who is authorised by the Client to use the services;
“Recruitment Agency” an Employment Agency or Employment Business as defined by the Employment Agencies Act 1973;
“Recruitment Process Outsourcing Agency” a Recruitment Agency who also carry out the selection and placement process on behalf of the End Client;
“Service” means collectively any online facilities, tools, services or information that Events 4 Healthcare Ltd makes available through the Web Site either now or in the future;
“Signed Agreement” Signed order between E4H and the Client documenting the services booked;
“Services” means the paid for services available to you through this Web Site, specifically job listings, banners, featured recruiter options, jobs of the week, CV bank, job alerts sponsorship, digital mailers, social media posting;
“Site” the site at https://www.pharmajobs.co.uk or any other sub domain of this site;
“Payment Information” means any details required for the purchase of Services from this Web Site. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;
“Purchase Information” means collectively any orders, invoices, receipts or similar that may be in hard copy or electronic form;
“Employer dashboard” Administrative area available to Clients to manage their Job listings and Company Profile;
“System” means any online infrastructure that E4H makes available through the Web Site either now or in the future. This includes, but is not limited to, recruiter administrative area, message boards and email links;
“User” / “Users” means any third party that accesses the Web Site and is not employed by E4H and acting in the course of their employment;
“Web Site” means the website that you are currently using (https://www.pharmajobs.co.uk; http://www.pharmafield.co.uk) and any sub-domains of this site (https://www.pfawards.co.uk) unless expressly excluded by their own terms and conditions;
2.Business Customers
These Terms and Conditions apply to business customers only.
3.Intellectual Property
3.1Subject to the exceptions in Clause 4 of these Terms and Conditions and the information provided by Client companies, all Content included on the Web Site, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of the Company. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.
3.2Subject to Clause 5 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by the Company
4.Fair Use of Intellectual Property
Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
You may print or download to a local hard disk extracts for your personal and non-commercial use only
You may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.
5.Links to Other Web Sites
This Site may contain links to other sites. Unless expressly stated, these sites are not under the control of E4H. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.
If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.
6.Services — General Use
6.1The Client agrees to provide E4H, in such a format as E4H may request, any information, design work, artwork and logos necessary to enable E4H to provide the agreed Services.
6.2The Company shall not be obliged to provide any Services until the Client has supplied it with the information, design work, artwork and logos necessary to provide those Services. Such information shall be supplied within 5 days of the date of the Signed Agreement, or such later date as agreed by E4H. If the Client fails to supply E4H with the information then clause 14.1 still applies
6.3E4H shall make such modifications to any Advertisement as are reasonably requested by the Client provided that E4H reserves the right to charge at the rate of 60 Pounds Sterling per hour for the time involved in connection with these changes
6.4The Client may remove an Advertisement from the Site before the Advertisement has reached its expiry date, but shall not be entitled to a refund for the time not used. The Client may extend the term of an Advertisement provided they have written confirmation of such an agreement.
6.5If any of the Services are not used within the agreed time frame, then in each case the Client shall still be responsible for the full payment of the invoiced amount as if the services had been properly and fully provided .
6.6E4H will use its reasonable endeavours to provide all Services on the agreed date. E4H does not accept liability for any consequences, however arising, due to error or delay in provision of the Services and has the right at its sole discretion to decline to publish or omit, suspend or change the position of any Advertisement or Services.
6.7E4H may at its discretion and without prior notice, report any Advertisement which in its reasonable opinion is being used for an improper or illegal purpose by a Client to the relevant authorities including, without limitation, the Department of Employment, the Office of the Information Commissioner and the Recruitment and Employment Confederation. E4H may also disclose information about any Client to any third party that it deems necessary to protect its interests or the interests of Clients, Recruiters, Candidates, Applicants and/or other users of the Site.
6.8E4H will only make available or supply copies of the CVs that have been received by it for distribution to Clients of E4H solely for the purpose of securing suitable employment for the Candidates.
6.9 When using any System or facility on the Web Site you should do so in accordance with the following rules:
6.9.1obscene or vulgar language must not be used;
6.9.2Content that is unlawful or otherwise objectionable must not be submitted. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
6.9.3Content that is intended to promote or incite violence must not be submitted;
6.9.4the means by which Users identify themselves must not violate these terms of use or any applicable laws;
6.9.5Users must not impersonate other people, particularly employees and representatives of E4H or our affiliates; and
6.10 You acknowledge that E4H reserves the right to monitor any and all communications made using our System.
7.Job Listings
If the Services include Job listings the provisions of this clause 7 shall apply.
7.1Job listings are to be inputted by the Client or a designated employee of the Client via the Employer Dashboard or Job Distribution Software approved by Pharmajobs;
7.2It is the Clients responsibility to upload their logo to their Recruitment Admin Area this should be 100 x 100 pixels max 50kb file size;
7.3Job listings will remain on the site in multiples of 28 days or otherwise agreed by contract with Pharmajobs;
7.4Job listings will remain live on the site and available for searching via the internet for the number of days specified by the Client;
7.5Any job listing(s) placed on the site by the client may be removed by the client at any time through the Employer Dashboard. The Client will be charged for the full number of days for which the job listing(s) were originally placed;
7.6A single job listing shall contain the details, accurately describe and pertain to no more than a single vacancy;
7.7E4H may edit, remove or refuse to publish any Job Listing it deems inappropriate;
7.8It is the Clients responsibility to renew these listings. E4H accepts no responsibility for any job listing being removed from the site when the expiry date is reached;
7.9The uploading of Job listings will not be permitted until a Signed Agreement, purchase through the site via paypal or Purchase Orde r is received by E4H from the Client;
7.10Where the Client chooses to use Job Distribution Software to submit a Job Listing(s), the Client accepts that any malfunction of, or change to, the Job Distribtuion Software or its incompatibility with E4H’s Systems causing incorrect, missing or multiple submissions to the site is entirely the responsibility of the Client and the Client agrees that any quota of services used and the Fees incurred will be payable in full;
8.Company Profiles
If the Services include Company Profile the provisions of this clause 8 shall apply.
8.1All Company Profiles will be loaded online by the Client unless otherwise stated . The content of the company profile should concur with clause 18.1 and should comply with all other provisions of the contract;
8.2E4H reserve the right to remove any content from a company’s profile should it deem it to be inappropriate;
8.3Company profiles will remain on the site until the end of the contracted period in multiples of 28 days;
9.Premium Banners or MPUs
If the Services include Premium Banners and/ or MPUs the provisions of this clause 9 shall apply.
9.1Premium Banners or MPUs may link to a Clients website or the Clients Job Listings;
9.2Premium Banners must be of the following dimensions 271 x 49 pixels;
9.3MPUs must be of the following dimensions 350 x 250 pixels
9.4It is the Clients responsibility to supply the Premium Banner to the correct specification;
9.5E4H may require the Premium Banner or MPU to be changed at any time in order that it contrasts suitably with the site;
9.6E4H may require the Premium Banners or MPUs to be changed if it is affecting the efficient functioning of the site;
9.7Premium Banners can be booked on to the homepage only
9.7Premium Banners will only appear on the home page that has pages that have been booked by the client in a Signed Agreement ;
9.8MPUs will only appear on the pages that have been booked by the client in a Signed Agreement
10.Top Banner
If the Services include a Top Banner the provisions of this clause 10 shall apply.
10.1Top Banners may link to a Clients website or the Clients job listings on the Site;
10.2Top Banners must be of the following dimensions 468 x 68 pixels;
10.3It is the Clients responsibility to supply the Top Banner to the correct specification;
10.4E4H may require the Top Banner to be changed at any time in order that it contrasts suitably with the site;
10.5E4H may require the Top Banners to be changed if it is affecting the efficient functioning of the site;
10.6Top banners can be booked on to the job search results page of the website;
10.7Top banners will only appear on the job search results page that has been booked by the client in a Signed Agreement;
11.CV Bank
If the Services include the CV Bank the provisions of this clause 11 shall apply.
11.1A CV is made available to a client following any instruction from a Candidate that his or her details should be made available. In the event that E4H has reason to believe or suspect that its CV bank is being abused by the client E4H reserves the right to immediately suspend or terminate the Contract;
11.2E4H cannot guarantee the minimum number of CVs available on any given day or the quality of the CVs within the bank
11.3The CV bank is available for the duration of the contracted time in multiples of 28 days as requested and paid for by the Client;
11.4The CV bank is only available to clients who have purchased job listings at the time of wishing to gain access to the CV bank;
11.5In relation to the CV bank the Client will ensure that under no circumstances will automatic extraction software or any other means be engaged or deployed, either temporary or a permanent basis with the purpose of creating a database of candidates for a Client’s own use at any other time . Unless specifically requested by the Client and approved in writing by the commercial director of E4H;
11.6E4H reserves the right to remove access to the CV bank at any time;
11.7Upon the completion of the Client’s contract, any contact information that is no longer needed for the current employment of a candidate, will be destroyed by the client. Unless specifically requested by the Client and approved in writing by the commercial director of E4H;
12.Job Alerts
If the Services include Job Alerts the provisions of this clause 12 shall apply.
12.1Job Alerts are only sent to Candidates that have requested to receive Job Alerts based on their chosen search criteria;
12.2Sponsorship of Job Alerts are available to Clients in the form of a Banner advertisement which can link to the Clients website or their Job listings only;
12.3E4H cannot guarantee how many job alerts will be sent out on a daily basis;
13.Termination and Cancellation
13.1Either E4H a Client or a User may terminate an Account and/or Contract. If E4H terminates your Account and/or contract, you will be notified by email, phone or letter and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons;
13.2If E4H terminates an Account/Contract, any current services will be stopped;
13.3E4H reserves the right to cancel services without stating reasons, for any reason prior to processing payment and dispatch;
13.4If services are cancelled by E4H the Purchaser will be reimbursed for any services paid for but not taken;
13.5If a Purchaser wishes to terminate their contract with E4H they must do so in writing with 60 days notice to the General Manager;
14.Payment
14.1Invoices will be issued by the Company
14.2All invoices must be settled within 30 days of the invoice date. If an invoice is overdue E4H reserves the right to suspend the use of the website;
14.3Failure to pay invoices in accordance with our terms and conditions will make Clients liable to the following surcharge. 3 per cent on the gross rate where the sum owing has been paid on the due date. A further 2 per cent, making a total of 5 per cent, on the gross rate, where the sum owing remains unpaid one month or more after the due date. The existence of a query on any individual item in an account shall not affect the due date of payment of the balance of the account;
15.Pricing and Availability
15.1E4H cannot guarantee that all services will be available;
15.2All pricing information on the Site is correct at the time of going online. E4H reserves the right to change prices from time to time and as necessary;
15.3All prices on the Web Site do not include VAT. E4H’s VAT number is 6237925;
15.4The rates shall be those rates as agreed between E4H and the Client in the Contract;
15.5 All quoted prices are excluding VAT unless otherwise specified
- Cancellation
16.1If the Customer wishes to cancel an Order, or to alter any Start Date(s), such request must be received in writing by the Company a minimum of five weeks prior to the Copy Deadline or Start Date. The Customer will be liable to pay in full for the Order where the Customer fails to comply with clause 4.1.
16.2Bulk Series discounts apply only to Orders completed within one year of the first advertisement being run. If the Customer cancels the Order before the series is complete then a surcharge will be made for advertisements already run at a discount, which will be an amount that represents the difference between the discounted charge and the rate card charge for a single advertisement for each advertisement that has run.
16.3In the event that copy for advertisements is not supplied by the Customer and advertisements are not therefore run for a series within the contractual period, then the Company reserves the right to charge a surcharge for advertisements already run at a discount, which will be an amount that represents the difference between the discounted charge and the rate card charge for a single advertisement for each advertisement run.
16.4The Customer remains liable for full payment where Material fails to be delivered to the Company by the agreed date.
16.5The Company reserves the right to refuse, withdraw, suspend or cancel the booking of any Order at its complete discretion. Unless such refusal, withdrawal or cancellation is due to an event of Force Majeure, or by reason of the breach of these Conditions by the Customer, the Company will refund to the Customer all money it has paid to the Company in respect of such Order. This refund is without prejudice to any claim that may be made by the Company under these Conditions.
17.Privacy

18.Disclaimers
18.1E4H makes no warranty or representation that the Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Services;
18.2The Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind;
19.Obligations of the Client
19.1The Client hereby undertakes and warrants to E4H that:
19.1.1To comply with the provisions of the Data Protection Act 2018 or relevant legislation with regard to any Applicant information received by it and in particular to keep such information confidential;
19.1.2In relation to any Services purchased the Client is a principal notwithstanding that the Client may be acting directly or indirectly for a third party;
19.1.3The reproduction and/or publication of any Top Banner, Premium Banner, Job Listings, Company Profile, Featured Recruiter or any other Service taken as originally submitted or as amended will not breach any agreement or infringe or violate any right of any person or render E4H liable to any proceedings whatsoever and the Client indemnifies E4H against all cost, claims, damages, loss, expenses and liabilities suffered or incurred by E4H as a result of this undertaking and warranty being incorrect;
19.1.4Any information provided by the Client in connection with the provision of the Services is accurate, complete and true;
19.1.5Any Advertisement is legal, decent, honest and truthful and complies with all applicable laws, rules, regulations and codes relating to advertising as may be appropriate;
19.1.6The Client must comply with all relevant industry Codes of Practice;
19.1.7The Client shall indemnify E4H against all claims made by the third parties in respect of the misuse of the data supplied to a client;
19.1.8The Client shall obtain from the Applicant as much information as possible about the Applicants qualifications and experience, as is necessary for determining whether the Applicant is suitable for employment, and shall ascertain that the Applicant has such qualifications as are required by law;
19.1.9The Client will use all CVs obtained for the sole purpose of endeavouring to provide or locate employment on behalf of Candidates Changes to the Service and these Terms and Conditions The Client must not submit, copy, supply, re-sell, distribute or make available in any way any CVs or other information received from E4H to any person unless the Client is a recruitment company where it may make CVs available to its genuine End Clients who intend to recruit such Candidates for their own employment;
20.Accounts
20.1In order to use the site Clients and Users are advised to create an Account which will contain certain personal details . By continuing to use this Site you represent and warrant that:
20.1.1All information you submit is accurate and truthful;
20.1.2If you are using the site on behalf of your employers, you have the authority required; and
20.1.3You will keep this information accurate and up-to-date.
20.2It is recommended that you do not share your Account details, particularly your username and password. E4H accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser;
20.3If you have reason to believe that your Account details have been obtained by another without consent, you should contact E4H immediately to suspend your Account. E4H accepts no liability or responsibility for unauthorised changes made to your account;
20.4When choosing a username Users are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account;
21.Disclaimer
21.1E4H reserves the right to change the Web Site, its Content or these Terms and Conditions at any time. Users and Purchasers will be bound by any changes to the Terms and Conditions from the first time the Web Site is used by them following the changes. If E4H is required to make any changes to Terms and Conditions relating to sale of services by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by Users in the future;
22.Availability of the Web Site
22.1The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality;
22.2E4H accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship;
23.Limitation of Liability
23.1To the maximum extent permitted by law, E4H accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk;
23.2Nothing in these Terms and Conditions excludes or restricts E4H liability for death or personal injury resulting from any negligence or fraud on the part of E4H ;
23.2 E4H accepts no liability for death or personal injury resulting from any negligence or fraud on the part of E4H ;
23.3E4H’s accepts no liability for any direct or indirect loss or damage arising out of the incorrect delivery of services or out of reliance on incorrect information included on the Web Site;
23.4Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal;
24.No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy;
25.Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise;
26.Notices
All notices/communications shall be given to us either by post to our Premises (see address above) or by email to hello@pharmfield.co.uk. Such notice will be deemed received three days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday;
27.Law and Jurisdiction
These terms and conditions and the relationship between you and E4H shall be governed by and construed in accordance with the Law of England and Wales and E4H and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales;

This policy (together with our terms and conditions and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
